If the master lease agreement did not grant the tenant the right to sublease to you in the first place, then, no, the subtenant may not sue his/her landlord.You may, however, be able to sue the person you subleased from if they lied to you about their rights to sublet to you in the first place. If you have a dispute with your landlord whether it is on a lease or sublease, and you cannot work things out on your own, contact an attorney who has experience in dealing with commercial contract disputes. The Master Lease Terms Apply Before you sublease from anyone, be koranvers that you see the master lease. Many landlords prohibit subleasing. If you sign a sublease with a tenant who does not have the right to sublease, you not only have few legal rights but you may even get evicted if the landlord finds out. The wording in the master lease is a key factor in determining i f a subtenant has the right to sue, as well as if the subtenant assumed the obligations of the master lease (i.e., did the take over the entire space and obligations or just have a back corner office?) State Courts Rely on Language in the Master Lease State courts have rendered varying decisions on cases where subtenants sued landlords. Because this area of law is still taking shape, it is best to consult with an attorney in your own state. However, in general, the terms in the master lease play an important role in determining if a subtenant can sue a landlord. The master lease may limit your rights to sue even if your sublease says you can sue the tenant listed in the master lease. For example, it is fairly common for leases to contain arbitration or mediation clauses. This means you agree that if there is a dispute between you and the landlord you will not head off to court. This is usually a good thing for both subtenant and landlord as long as it does not state that you tot ally forfeit your rights to sue if an agreement cannot be reached. These clauses should name a specific mediation or arbitration company - not an individual. The arbitrator should be neutral- not someone affiliated with the landlord or their representative. Landlord Breaches Are Not Always Torts It is important to understand that if your landlord or the tenant you sublease from breaches the lease you generally cannot sue for tort damages (i.e., what laypeople commonly refer to as pain and suffering.) Only in the case of certain types of conduct or badeanstalt faith is there a possibility of suing for tort damages. Suing anyone is rarely profitable so never sign a lease with the idea that if there is trouble, you can just take a bad landlord to court and win. It is always better to sign an agreement you understand and are comfortable with and only with a landlord you feel you can trust.

I’m talking about a private, intimate journal; a daily record of your experiences and observations, particularly at work.This type of journal is an unexpectedly great way to help you work through issues, analyze where you’re at in your job, and grow in your career. There are multiple designs in the works for vehicles meant to cross the skies at more than five times the speed of sound. These sleek, futuristic planes could reduce a trip from London to Sydney to four hoursor eleven minutes, depending on what youre willing to believemaking the Concorde look like a horse and buggy. But achieving routine speeds over Mach 5 is only one part of the problem. Creating a shell that will survive those speeds is another. Temperatures at the surface of aircraft moving that fast can reach 3000 degrees Celsius, enough to destroy almost any material currently used in flight. Now researchers at the University of Manchester have created something that will leave hypersonic nose cones and leading edges intact. Its an ultra-high temperature ceramic, or a UHTC, mated with a carbon-carbon composite. On their own, carbon-carbon composites are pretty tough, with sufficiently high melting points. But they cant survive the oxidization that occurs at such speeds. UHTCs are also incredibly hard, used primarily in tool bits for cutting tools, but theyre incredibly brittle as well. If you coat a vehicle with the stuff and then punch through the atmosphere at Mach 5, it will crack and peel right off. The two-stage vehicle will be powered by rocket propulsion. Image: DLR Put them together, however, and these problems evaporate. The only question is how. Ceramics are typically made into a powder, which is then pressed into a mold. This coating can fall off easily, says Ping Xiao, a professor of materials science at the university, who led the research. What we did was use liquid metalszirconium and titaniumto infiltrate the carbon-carbon composite. The carbon-carbon composite is porous, so the UHTC infiltrates the fibers and the two materials become integrated. The result is a coatingthat is likely to survive the extreme conditions of hypersonic flight. The technique has other advantages in addition to the hardiness of the product. To keep them from becoming too brittle, the geometry of the molds used with ceramics in a powder form have to be kept fairly simple. With Xiaos method, the coating can be as complex as needed. The depth of the ceramic infiltration can be anywhere between one and two hundred microns, adjusted to meet the needs of the specific application. More important, perhaps, is the low cost of production. This process is potentially cheaper than using powder, because we are not using any mold to press a component, says Xiao. And we are not using anything exotic, from my point of view. The potential applications go well beyond hypersonic flight. The new material could be used to extend the life of the nozzle throats and diffusers in reusable rockets or to coat the contact points for re-entry vehicles. The gas turbine, nuclear, and defense industries would have multiple uses for such a material. But theres work to be done before then. This is our fist step.
